But he wasn't. British banker Barings and Amsterdam banker Hope & Co. were happy to syndicate a loan for the French in the city. The bond issue sold out, and the prices of French rentes went up. Everyone made lots of money, and best of all, Louis XVIII got himself and the French people out of a jam so they could go on to lose three wars to the Germans in less than a century.

Over the weekend, news broke that Universal moved their prequel of John Carpenter’s The Thing, also called The Thing, into release date limbo. Official word from the studio was the film was “not yet ready” and fanboy worry and speculation began. Does the film suck? Do the effects looks stupid? Performances stink? All of the above? The answer, in fact, is none of the above. Producer Marc Abraham clarified to Hitfix that while they already have a cut of the film, the release date shift has allowed them to schedule additional photography that will “enhance existing sequences,” “make crystal clear a few story beats” and “add punctuation marks to the film’s feeling of dread.”

So while we are going to have to wait a little longer to see director Matthijs van Heijningen Jr.’s version of The Thing, starring Mary Elizabeth Winstead and Joel Edgerton, the film we do eventually see will be better for it. Read more after the jump.

In his discussion with Hitfix’s Drew McWeeny, Abraham reportedly stressed that “they’re looking at everything right now to make sure they’ve got what they need.” This is luxury very few studio films have. Once a movie is saddled with a release date, they are usually beholden to it. Filmmakers work and work and work on the film until the prints need to be locked and sent to theaters. The film is then ripped from their hands so we can see it. So, at a certain point, story becomes secondary to just making sure the effects and sound are up to theatrical standards. If franchise films like Transformers or Iron Man didn’t have to adhere to a release date, 90% of the time, some reshoots would make the film infinitely better.

Fitch Ratings-New York-04 November 2010: Fitch Ratings has assigned a Negative Outlook for the entire U.S. Residential Mortgage Servicer ratings sector on increased concerns surrounding alleged procedural defects in the judicial foreclosure process.
 
'Risks to servicers include cost to research and remediate any errors, additional fees and resources, potential penalties and reputational risk,' said Diane Pendley, Managing Director and head of U.S. RMBS Operational Risk for Fitch.
 
This industry-wide issue will cause all servicers to be under increased scrutiny from a wide range of state and federal regulators, state attorneys general, and GSE's. All servicers will be affected, even those fully in compliance with all foreclosure rules and regulations. This is due to the increased amount of time and manpower it will take to properly address the much higher level of oversight and inquiries that are received, as well as the anticipated additional court delays.
 
Fitch's Rating Outlooks indicate the likely direction of any rating change over a one- to two-year period and may be Positive, Negative, Stable or, occasionally, Evolving.
 
Fitch has received responses to its recent survey from all of its rated servicers regarding the servicers' specific internal procedures used to verify and execute foreclosure affidavits. All servicers have indicated that they are taking this matter seriously and have reviewed or are in the process of reviewing their internal procedures used to verify and execute foreclosure affidavits.
 
Approximately one-third of Fitch's rated servicers have completed their reviews of foreclosure processes and the accuracy of their foreclosure affidavits.

These servicers do not believe they will need to take any corrective action or make any changes to their current processes at this time. Some servicers have estimated that they will be able to complete their review within the next several weeks, while others are still unable to give a specific estimate of how long it may take to complete their reviews.
 
However, 'all servicers appear to be working towards quantifying and defining their position on foreclosures,' said Pendley. Therefore, Fitch expects all servicers will have substantially completed their internal reviews by the end of the fourth quarter.
 
Based on the research that the servicers have completed to date on these issues, all servicers generally maintain the factual accuracy of their affidavits.

However, some have found their procedures for reviewing, signing and notarizing foreclosure documents may require changes and corrective actions. Some servicers have announced publicly that they have halted certain foreclosure and liquidation actions until their reviews are completed.
 
Many servicers have also stated that they will be resuming the foreclosure and liquidation actions in identified jurisdictions as they complete their reviews and determine that their processes are adequate and any needed corrective actions have been taken.
 
Fitch has requested its rated servicers to provide estimates on the volumes and timeframes for submitting corrected affidavits when it is found to be necessary and as this information becomes available. However, the servicer's ability to resolve each corrective action at the local court level will create a wide variety of remedial steps and associated timeframes. 'Final resolution of the foreclosure affidavit concerns and the multiple resulting investigations, along with assigned ownership rights prior to initiating foreclosure actions, may not occur until well into 2011 and possibly beyond,' said Pendley.
 
Fitch has discussed with its rated servicers their ability to track and segregate the additional costs associated with taking any corrective actions.

If corrective actions are needed because of a servicer error, any increased costs should be borne by the servicers and not passed through to the trusts.

These increased costs may include legal costs to correct and file new or amended foreclosure documents and the increased carrying costs for the extended foreclosure and liquidation timelines.
 
Fitch may place an individual servicer's ratings on Rating Watch Negative and/or downgrade the ratings if the servicer does not diligently and timely review its processes and take immediate corrective action to remediate any foreclosure action or documentation failures. Fitch may take similar actions on a servicer's ratings if the impact of the additional costs that must be borne by the servicer significantly affects its financial condition.  Until those conclusions are reached, the Negative Outlook on the sector impacts all U.S. RMBS servicers.
 
An increase in loss severities on liquidated loans from expected trend lines or any downgrades to servicer ratings may result in negative rating actions on related RMBS classes.  As a direct by-product of the recent foreclosure issues, Fitch currently expects any negative rating actions on RMBS tranches to be limited largely to non-investment grade classes and tranches that currently have a Negative Rating Outlook. Additionally, Fitch does not envision RMBS downgrades to exceed a single rating category in most cases.

We’re a little puzzled at the attention a Florida robo-signing case has garnered. A plaintiff tried arguing that robo signing alone constituted a reason to dismiss a foreclosure. That’s such a stretch that it is no wonder a judge decided against the borrower argument.

Mind you, we think robo signing is serious because it is a fraud on the court and will almost assuredly be more complicated to clean up than the banks would have you believe. But the presence of a robo signer in and of itself is very unlikely to do much for the cause for an individual homeowner. The real implications are twofold. First is that the cost and hassle of banks straightening out this mess are serious. Not only will they have to spend more on foreclosures going forward, not merely getting proper signatures and notarizations, but also verfying the accuracy of the underlying information. And the state of Ohio is on a warpath, seeking to impose $25,000 fines for each improper affidavit. Second, some judges may make servicers start cases from scratch where a false affidavit has been submitted.

When banks find errors, as Bank of America has, what will the judge do?

HousingWire gives a report on this Florida case:

In Freemon v. Deutsche Bank, Florida’s Fourth District Court of Appeal ruled that an allegedly faulty affidavit didn’t constitute fraud in the case.

“Freemon’s motion does not demonstrate fraud or show why any of the alleged facts would entitle her to relief sufficient to set aside a default judgment,” the court ruled this week. “Freemon nowhere contends that she did not default on her mortgage, nor does she allege that the amounts due and owing, set forth in the affidavit and incorporated in the final judgment, are incorrect.”

In November 2007, Deutsche Bank filed to foreclosure against the homeowner, Veldrin Freemon, alleging she owed more than $570,000 on the mortgage note. Freemon didn’t answer the foreclosure complaint and a default judgment was entered. She later contested the case and it was delayed for six months. A foreclosure sale was reset for September 2009, and the property was sold back to the bank. When the bank sought to repossess the home after the sale, however, Freemon filed for relief from the judgment, alleging that an affidavit in the case was fraudulent.

The allegation of fraud was based on a deposition in another foreclosure case from a Litton Loan employee who was signing foreclosure affidavits without personal knowledge of their contents.

The court ruled that the deposition was insufficient to prove fraud and disagreed with Freemon’s characterization of the Litton Loan affidavit from Denise Bailey.

Freemon claimed that Bailey claimed personal knowledge of the matters in the affidavit yet she did not know who inputted information into the computer regarding the loan in question.

I pinged a lawyer who has been following securitization cases. HIs reply:

Very narrow ruling with limited implications.

I haven’t reviewed the case, but it doesn’t look like this borrower was connected to any of the people we know because it was a very incomplete argument.

Facts (as far as I can tell from the article):

Borrower was foreclosed. Later learns about robo-signers, and uses deposition from another case to argue the foreclosure should be overturned because the robo-signer admitted in the other case that she didn’t personally verify facts in the affidavit.

Appeals court dismissed borrowers complaint because the borrower didn’t present sufficient evidence of fraud or that any facts reviewed by the court in the original foreclosure case were in dispute. The borrower didn’t present any specific information regarding fraud in her case.

I did not see this as a ruling that robo-signing was not fraud. Rather, the judge said that the allegations about another case’s deposition were insufficient to show that an existing ruling (the house was already foreclosed and sold) should be vacated. The appeals court ruled that they would not over rule a trial court’s review of the facts without compelling evidence, which was not presented in this case.

I find the perspective of the article’s author and of Paul Jackson to be curious. The author said it was “good news for servicers” and Jackson said it was “huge news” because it found “robo-signing” was not fraud.

It seems very odd to me to be cheerleading for servicers’ right to submit bad information to the courts. That is a measure of just how far banks, and their minions, are willing to twist themselves over this issue.

In addition, this is far from a huge ruling. The borrower seems to have made a very weak case – first they didn’t challenge the foreclosure until after it was sold. Then, they only presented evidence from another case, without making any factual assertions in their own case (perhaps the goal was to re-open the case so they could take their own depositions, but this is a far more difficult route to attempt). In addition, they also tried to assert that the issue was “fraud”, which is, as you know, a very tough legal hurdle which requires the proof of “intent” which is difficult to establish.

While we’ll be seeing more fallout of the robo signing scandal, it’s more a symptom of deeper problems in the securitization process, namely, widespread disregard for contracts and legal procedures, than a huge issue in and of itself. But it will still be generating embarrassing stories for weeks and higher costs on an onging basis.

Making Money Secrets

As you all know, that mashed-up bag of gas with pancake make-up on it Keith Olbermann has been “suspended indefinitely” by MSNBC for making and failing to disclose political contributions to three Democrats — including open-borders Democrat Rep. Raul Grijalva, whom he hosted on the same day he forked over a donation.

Unlike Fox News (pay attention, Media Matters Soros-bots), NBC ethics guidelines (yes, they do have them) bar their employees from making political contributions. (FNC’s real-world, pro-free speech rules allow donations as long “as long as the activity does not interfere with or impair the performance of the employee’s duties for the Company.”)

Politico got the scoop on Olbermann’s donations to Grijalva, AZ Democrat Rep. Gabrielle Giffords, and failed Kentucky Democrat Senate candidate Jack Conway by sifting through FEC records.

Bill Kristol is rallying conservatives to support Olbermann.

MSNBC’s suspension of Keith Olbermann is ludicrous. First, he donated money to candidates he liked. He didn’t take money, or favors, in a way that influenced his reporting. Second, he’s not a reporter. It’s an opinion show. If Olbermann wants to put his money where his mouth is, more power to him.Republicans of the world, show you believe in the free expression of opinion! Tell the crony corporatists at NBC—keep Keith!

Pardon my MSNBC-like incivility, but are you freaking kidding me? Hoping Kristol’s tongue is firmly planted in cheek, but plenty of people are taking him seriously.

Olbermann railed against FNC in August for its corporate donations while whitewashing NBC/GE’s:

On the August 17 edition of ‘Countdown,’ host Keith Olbermann used the donations to do the only thing he’s capable of doing: criticizing Fox News.

“We now have another million reasons why Fox News is the Republican news channel, correct?” Olbermann asked Media Matters president Eric Burns.

Olbermann said that GE, MSNBC’s parent company, donated an equal amount of money to both the DGA and RGA. He didn’t mention, however, that according to OpenSecrets.org, in 2008, 100 percent of MSNBC Cable’s donations went to Democrats and 99 percent of NBC’s donations went to Democrats.

Additionally, so far in 2010, 100 percent of ABC News’s donations have gone to Democrats and CBS Corporation’s PAC has contributed $51,000 to Democrats in 2010.

The Media Research Center previously noted News Corp.’s donations favored Democrats and that other outlets critical of the donation, such as Viacom’s Comedy Central, have all given substantial money to Democrats, yet there is no outrage over their political contributions.

Olbermann’s sanctimony and hypocrisy only compound his core failure to disclose the donations before Election Day — especially during the show in which he hosted one of the beneficiaries of that cash.

REP. RAUL GRIJALVA (D), ARIZONA: Good to talk to you, my friend.

OLBERMANN: Is there anything you can tell us about the relationship between these private prisons and the lawmakers who supported this monstrosity of a bill?

GRIJELVA: It is a wonderful I told you so moment. But, at the same time, we”ve been battered for the six months for our opposition to 1070, not just myself but others. And we don”t know how much they”ve contributed to these independent expenditure campaigns, the private prison industry.

But you used the word citizens. It”s disgusting, cynical and disgusting that they were bragging about there”s going to be more women and children detained, so therefore this is a market for us.

And the fact of the matter is Russell Pearce and Jan Brewer made a decision to put this law in effect. It had had nothing to do with border security. It had nothing to do with the security of the state. It had to do with the profit line.

And, you know, I”m glad that NPR did this. I”m glad “In These Times” did that. Finally, it”s catching some attention. But it comes at the end of a campaign when many of us have been battered for six months because of our opposition to 1070.

It is–you used the word cynical. It is past cynical. It is using

a very tough situation in the state of Arizona when it comes to immigration

using it to make a profit and using people, when we should be talking about how you we”re going to reform this law. It”s unbelievable.

OLBERMANN: It”s almost extraordinary to believe that once we got past the original phony reason for it, which was security at the border, when obviously it didn”t pertain to that whatsoever, that the real reason behind that was well, this is to intimidate people of Hispanic descent. Well, it turns out there”s an even more base, cynical reason behind it.

Am I wrong about this? When they talk about making money, it”s not–they”re not talking about people who are going to be in jail because they”ve been convicted of anything. This would be making money off people who are held and then found to have violated no laws, correct? They make money whether something”s guilty or innocent, correct?

GRIJALVA: It”s filling beds and spaces, period. It”s about detention. It”s about building private prisons, filling them, taking a profit from the federal government, and with that profit continuing to expand the bottom line. The advisers for Jan Brewer are part of this. The people that wrote the law for Russell Pearce of part of this. They”re all going to make millions of dollars off of this.

What expense? The division in Arizona, the division across this country. They get to go blithely walk away with their money, leaving behind the kind of social mess they”ve left all over this country. It is for me one of the most corrupt political acts. Because you use people. You use the emotions involved and you make a profit.

OLBERMANN: I can”t insure your house for fire, because legally that would give me a motivation for wanting to see your house catch fire. I mean, the idea of private prisons–suddenly, we see the flaw in that idea, too, that if they”re private prisons run for profit, there”s going to be a motive to put people in prison who don”t belong there.

GRIJALVA: That and the private prison industry here in Arizona has a wonderful test case. Murderers escaped from a private public. They haven”t escaped from a public prison. That”s Jan Brewer”s agenda. That is the extreme right”s agenda here.

I think–I hope people–I think people in Arizona are now seeing through the cloud and realizing that this is not just about immigration. This is not just about border security. There”s an insidious reason we”re involved in this really tough, tough issue. That is that somebody is making money off of it.

OLBERMANN: Lastly, any idea why the governor is going to San Francisco?

GRIJALVA: Well, she hasn”t debated. She wants to avoid the questions that are pressing about her relationship to this private prison industry and why they wrote the law. The people on her staff that are running her campaign and her chief of staff, I”m assuming that she wants to avoid those questions.

OLBERMANN: Congressman Raul Grijalva of Arizona, it”s always a pleasure and an education. I”m sorry it”s always about something like this. Thanks for your time.

GRIJALVA: Thank you.

Olby’s defenders say it’s wrong to punish opinion journalists for supporting candidates and causes.

But:

1) MSNBC has always promoted and allowed Olbermann to preen as an award-winning journalist and broadcaster of Edward R. Murrow’s caliber — above the fray and superior to the rest of us in the print/broadcast media who are open and honest about our political and ideological biases.

2) Whatever NBC’s guidelines may be, it was the basic journalistic failure of the Murrow wanna-be to disclose the donation on the night he hosted one of his cash recipients that seals his fate and undermines whatever iota of credibility his station has left.

HOW many times over the years have we seen mainstream media elites get on their high horse about their unbending commitment to objectivity?

Wear ribbons after the 9/11 attacks? Heavens, no, the news poobahs swooned. Stacey Woelfel, news director at KOMU-TV in Columbia, Mo., directed his staff to “leave the ribbons at home” to show viewers “that in no way are we influenced by the government in informing the public.”

Display the flag during wartime? Heavens, no, cried the dinosaur networks. ABC News spokesman Jeffrey Schneider told The Washington Post: “Especially in a time of national crisis, the most patriotic thing journalists can do is to remain as objective as possible . . . We cannot signal how we feel about a cause, even a justified and just cause, through some sort of outward symbol.”

And dole out political cash while on the job? Heavens, n-oh, wait a minute. That unbending commitment to neutrality is really nothing but a Wetzel’s pretzel.

Despite all the past protestations about the need to avoid outward signs of partiality, we now learn that journalists in America’s top newsrooms overwhelmingly donate to Democrat causes and candidates (shocker!) – and that they’ve been giving despite clear prohibitions and conflicts of interest.

MSNBC.com’s Bill Dedman found 144 journalists who’d made political donations to candidates, parties and causes from 2004 through the start of the 2008 campaign. Nine out of 10 – 125 in total – gave to Democrats and liberal groups; only 17 gave to Republicans, while two gave to both parties. The donors include war correspondents who gave while embedded or on the war beat, The New York Times’ ethics columnist and several news anchors who crusaded and signed petitions against the war.

Adding insult to self-injury, every single one of these donors – who work in an industry that crusades for openness, disclosure, and transparency – failed to inform their viewers, readers and bosses of their political activities.

So much for “Sunlight is the best disinfectant.”

Ok, poll time:

I think it was the timing of the end of the torture investigation that hurts most of all. Just days ago, Harold Koh was boasting of the Durham investigation to the UN. Then Bush started his dog and pony show, including his proud admission to have ordered up torture. All of which made today’s announcement, that no one will be charged for covering up evidence of torture, almost anti-climactic.

Of course no one will be charged for destroying the evidence of torture! Our country has spun so far beyond holding the criminals who run our country accountable that even the notion of accountability for torture was becoming quaint and musty while we waited and screamed for some kind of acknowledgment that Durham had let the statute of limitations on the torture tape destruction expire. I doubt they would have even marked the moment–yet another criminal investigation of the Bush Administration ending in nothing–it if weren’t for the big stink bmaz has been making. Well, maybe that’s not right–after all, Bob Bennett was bound to do a very public victory lap, because that’s what he’s paid for.

The investigation continues, DOJ tells us, into obstruction of the Durham investigation itself. Maybe they think they’ve caught someone like Porter Goss in a lie. But at this point, that almost seems like a nice story the prosecutors are telling themselves so they can believe they’re still prosecutors, so they can believe we still have rule of law in this country.

This inquiry started long before Obama started looking forward, not backward. It started before the White House allowed the Chief of Staff to override the Attorney General on Gitmo and torture. It started before we found out that someone had destroyed many of the torture documents at DOJ–only to find no one at DOJ cared. It started before the Obama DOJ made up silly reasons why Americans couldn’t see what the Vice President had to say about ordering the leak of a CIA officer’s identity. It started before the Obama White House kept invoking State Secrets to cover up Bush’s crimes, from illegal wiretapping, to kidnapping, to torture. It started at a time when we naively believed that Change might include putting the legal abuses of the past behind us.

This inquiry started before the Obama Administration assumed the right to kill American citizens with no due process–all the while invoking State Secrets to hide that, too.

This inquiry started before Bush and then Obama let BP get away with serial violations of the laws that protect our workers and environment, and then acted surprised when BP ruined our Gulf.

This inquiry started before Obama helped to cover up the massive fraud committed by our banks, even while it continued to find ways to print money for those same banks. It started, too, before the Obama Administration ignored mounting evidence that banks–the banks employed by taxpayer owned Fannie and Freddie–were foreclosing on homes they didn’t have the legal right to foreclose on, going so far as to counterfeit documents to justify it. This inquiry started when we still believed in the old-fashioned principle of property rights.

This inquiry started before banksters got excused when they mowed down cyclists and left the scene of the crime, because a felony would mean the bankster would lose his job.

The ACLU’s Anthony Romero reacted to this news saying, in part, “We cannot say that we live under the rule of law unless we are clear that no one is above the law.”

As you all know, that mashed-up bag of gas with pancake make-up on it Keith Olbermann has been “suspended indefinitely” by MSNBC for making and failing to disclose political contributions to three Democrats — including open-borders Democrat Rep. Raul Grijalva, whom he hosted on the same day he forked over a donation.

Unlike Fox News (pay attention, Media Matters Soros-bots), NBC ethics guidelines (yes, they do have them) bar their employees from making political contributions. (FNC’s real-world, pro-free speech rules allow donations as long “as long as the activity does not interfere with or impair the performance of the employee’s duties for the Company.”)

Politico got the scoop on Olbermann’s donations to Grijalva, AZ Democrat Rep. Gabrielle Giffords, and failed Kentucky Democrat Senate candidate Jack Conway by sifting through FEC records.

Bill Kristol is rallying conservatives to support Olbermann.

MSNBC’s suspension of Keith Olbermann is ludicrous. First, he donated money to candidates he liked. He didn’t take money, or favors, in a way that influenced his reporting. Second, he’s not a reporter. It’s an opinion show. If Olbermann wants to put his money where his mouth is, more power to him.Republicans of the world, show you believe in the free expression of opinion! Tell the crony corporatists at NBC—keep Keith!

Pardon my MSNBC-like incivility, but are you freaking kidding me? Hoping Kristol’s tongue is firmly planted in cheek, but plenty of people are taking him seriously.

Olbermann railed against FNC in August for its corporate donations while whitewashing NBC/GE’s:

On the August 17 edition of ‘Countdown,’ host Keith Olbermann used the donations to do the only thing he’s capable of doing: criticizing Fox News.

“We now have another million reasons why Fox News is the Republican news channel, correct?” Olbermann asked Media Matters president Eric Burns.

Olbermann said that GE, MSNBC’s parent company, donated an equal amount of money to both the DGA and RGA. He didn’t mention, however, that according to OpenSecrets.org, in 2008, 100 percent of MSNBC Cable’s donations went to Democrats and 99 percent of NBC’s donations went to Democrats.

Additionally, so far in 2010, 100 percent of ABC News’s donations have gone to Democrats and CBS Corporation’s PAC has contributed $51,000 to Democrats in 2010.

The Media Research Center previously noted News Corp.’s donations favored Democrats and that other outlets critical of the donation, such as Viacom’s Comedy Central, have all given substantial money to Democrats, yet there is no outrage over their political contributions.

Olbermann’s sanctimony and hypocrisy only compound his core failure to disclose the donations before Election Day — especially during the show in which he hosted one of the beneficiaries of that cash.

Here is the full transcript of the Olbermann/Grijalva interview on Oct. 28, the day Olbermann donated the maximum to Grijalva’s re-election bid:

REP. RAUL GRIJALVA (D), ARIZONA: Good to talk to you, my friend.

OLBERMANN: Is there anything you can tell us about the relationship between these private prisons and the lawmakers who supported this monstrosity of a bill?

GRIJELVA: It is a wonderful I told you so moment. But, at the same time, we”ve been battered for the six months for our opposition to 1070, not just myself but others. And we don”t know how much they”ve contributed to these independent expenditure campaigns, the private prison industry.

But you used the word citizens. It”s disgusting, cynical and disgusting that they were bragging about there”s going to be more women and children detained, so therefore this is a market for us.

And the fact of the matter is Russell Pearce and Jan Brewer made a decision to put this law in effect. It had had nothing to do with border security. It had nothing to do with the security of the state. It had to do with the profit line.

And, you know, I”m glad that NPR did this. I”m glad “In These Times” did that. Finally, it”s catching some attention. But it comes at the end of a campaign when many of us have been battered for six months because of our opposition to 1070.

It is–you used the word cynical. It is past cynical. It is using

a very tough situation in the state of Arizona when it comes to immigration

using it to make a profit and using people, when we should be talking about how you we”re going to reform this law. It”s unbelievable.

OLBERMANN: It”s almost extraordinary to believe that once we got past the original phony reason for it, which was security at the border, when obviously it didn”t pertain to that whatsoever, that the real reason behind that was well, this is to intimidate people of Hispanic descent. Well, it turns out there”s an even more base, cynical reason behind it.

Am I wrong about this? When they talk about making money, it”s not–they”re not talking about people who are going to be in jail because they”ve been convicted of anything. This would be making money off people who are held and then found to have violated no laws, correct? They make money whether something”s guilty or innocent, correct?

GRIJALVA: It”s filling beds and spaces, period. It”s about detention. It”s about building private prisons, filling them, taking a profit from the federal government, and with that profit continuing to expand the bottom line. The advisers for Jan Brewer are part of this. The people that wrote the law for Russell Pearce of part of this. They”re all going to make millions of dollars off of this.

What expense? The division in Arizona, the division across this country. They get to go blithely walk away with their money, leaving behind the kind of social mess they”ve left all over this country. It is for me one of the most corrupt political acts. Because you use people. You use the emotions involved and you make a profit.

OLBERMANN: I can”t insure your house for fire, because legally that would give me a motivation for wanting to see your house catch fire. I mean, the idea of private prisons–suddenly, we see the flaw in that idea, too, that if they”re private prisons run for profit, there”s going to be a motive to put people in prison who don”t belong there.

GRIJALVA: That and the private prison industry here in Arizona has a wonderful test case. Murderers escaped from a private public. They haven”t escaped from a public prison. That”s Jan Brewer”s agenda. That is the extreme right”s agenda here.

I think–I hope people–I think people in Arizona are now seeing through the cloud and realizing that this is not just about immigration. This is not just about border security. There”s an insidious reason we”re involved in this really tough, tough issue. That is that somebody is making money off of it.

OLBERMANN: Lastly, any idea why the governor is going to San Francisco?

GRIJALVA: Well, she hasn”t debated. She wants to avoid the questions that are pressing about her relationship to this private prison industry and why they wrote the law. The people on her staff that are running her campaign and her chief of staff, I”m assuming that she wants to avoid those questions.

OLBERMANN: Congressman Raul Grijalva of Arizona, it”s always a pleasure and an education. I”m sorry it”s always about something like this. Thanks for your time.

GRIJALVA: Thank you.

Olby’s defenders say it’s wrong to punish opinion journalists for supporting candidates and causes.

But:

1) MSNBC has always promoted and allowed Olbermann to preen as an award-winning journalist and broadcaster of Edward R. Murrow’s caliber — above the fray and superior to the rest of us in the print/broadcast media who are open and honest about our political and ideological biases.

2) Whatever NBC’s guidelines may be, it was the basic journalistic failure of the Murrow wanna-be to disclose the donation on the night he hosted one of his cash recipients that seals his fate and undermines whatever iota of credibility his station has left.

HOW many times over the years have we seen mainstream media elites get on their high horse about their unbending commitment to objectivity?

Wear ribbons after the 9/11 attacks? Heavens, no, the news poobahs swooned. Stacey Woelfel, news director at KOMU-TV in Columbia, Mo., directed his staff to “leave the ribbons at home” to show viewers “that in no way are we influenced by the government in informing the public.”

Display the flag during wartime? Heavens, no, cried the dinosaur networks. ABC News spokesman Jeffrey Schneider told The Washington Post: “Especially in a time of national crisis, the most patriotic thing journalists can do is to remain as objective as possible . . . We cannot signal how we feel about a cause, even a justified and just cause, through some sort of outward symbol.”

And dole out political cash while on the job? Heavens, n-oh, wait a minute. That unbending commitment to neutrality is really nothing but a Wetzel’s pretzel.

Despite all the past protestations about the need to avoid outward signs of partiality, we now learn that journalists in America’s top newsrooms overwhelmingly donate to Democrat causes and candidates (shocker!) – and that they’ve been giving despite clear prohibitions and conflicts of interest.

MSNBC.com’s Bill Dedman found 144 journalists who’d made political donations to candidates, parties and causes from 2004 through the start of the 2008 campaign. Nine out of 10 – 125 in total – gave to Democrats and liberal groups; only 17 gave to Republicans, while two gave to both parties. The donors include war correspondents who gave while embedded or on the war beat, The New York Times’ ethics columnist and several news anchors who crusaded and signed petitions against the war.

Adding insult to self-injury, every single one of these donors – who work in an industry that crusades for openness, disclosure, and transparency – failed to inform their viewers, readers and bosses of their political activities.

So much for “Sunlight is the best disinfectant.”

Ok, poll time:

I think it was the timing of the end of the torture investigation that hurts most of all. Just days ago, Harold Koh was boasting of the Durham investigation to the UN. Then Bush started his dog and pony show, including his proud admission to have ordered up torture. All of which made today’s announcement, that no one will be charged for covering up evidence of torture, almost anti-climactic.

Of course no one will be charged for destroying the evidence of torture! Our country has spun so far beyond holding the criminals who run our country accountable that even the notion of accountability for torture was becoming quaint and musty while we waited and screamed for some kind of acknowledgment that Durham had let the statute of limitations on the torture tape destruction expire. I doubt they would have even marked the moment–yet another criminal investigation of the Bush Administration ending in nothing–it if weren’t for the big stink bmaz has been making. Well, maybe that’s not right–after all, Bob Bennett was bound to do a very public victory lap, because that’s what he’s paid for.

The investigation continues, DOJ tells us, into obstruction of the Durham investigation itself. Maybe they think they’ve caught someone like Porter Goss in a lie. But at this point, that almost seems like a nice story the prosecutors are telling themselves so they can believe they’re still prosecutors, so they can believe we still have rule of law in this country.

This inquiry started long before Obama started looking forward, not backward. It started before the White House allowed the Chief of Staff to override the Attorney General on Gitmo and torture. It started before we found out that someone had destroyed many of the torture documents at DOJ–only to find no one at DOJ cared. It started before the Obama DOJ made up silly reasons why Americans couldn’t see what the Vice President had to say about ordering the leak of a CIA officer’s identity. It started before the Obama White House kept invoking State Secrets to cover up Bush’s crimes, from illegal wiretapping, to kidnapping, to torture. It started at a time when we naively believed that Change might include putting the legal abuses of the past behind us.

This inquiry started before the Obama Administration assumed the right to kill American citizens with no due process–all the while invoking State Secrets to hide that, too.

This inquiry started before Bush and then Obama let BP get away with serial violations of the laws that protect our workers and environment, and then acted surprised when BP ruined our Gulf.

This inquiry started before Obama helped to cover up the massive fraud committed by our banks, even while it continued to find ways to print money for those same banks. It started, too, before the Obama Administration ignored mounting evidence that banks–the banks employed by taxpayer owned Fannie and Freddie–were foreclosing on homes they didn’t have the legal right to foreclose on, going so far as to counterfeit documents to justify it. This inquiry started when we still believed in the old-fashioned principle of property rights.

This inquiry started before banksters got excused when they mowed down cyclists and left the scene of the crime, because a felony would mean the bankster would lose his job.

The ACLU’s Anthony Romero reacted to this news saying, in part, “We cannot say that we live under the rule of law unless we are clear that no one is above the law.”

I think it’s clear. We cannot say we live under the rule of law.
